These Terms of Service form a binding agreement between AiBrush AB and you. They govern your access to and use of AiBrush Studio, including the creation tools, the asset library, Ad Studio, and every plan. In short: you must be an adult, you keep your content, credits are consumed as you generate and the statutory right of withdrawal ends once purchased credits are used, and Swedish law applies while consumers keep the mandatory protections of their home country.
The service is provided by AiBrush AB, a Swedish limited company (registration number 559508-8757, VAT number SE559508875701) with its registered office at Norra Fjädermolnsgatan 27, 418 42 Gothenburg, Sweden (“AiBrush”, “we”, “us”). You can reach us at support@aibrush.co or info@aibrush.co.
In these Terms, “Service” means the AiBrush Studio web application at aibrush.co and its related domains, including the creation tools, the asset library, Ad Studio, and the public website; “Inputs” means prompts, reference media, documents, voice samples, settings, and any other material you provide; “Outputs” means the images, video, audio, music, sound effects, text, and other material the Service generates for you; “Credits” means the units of use consumed by generations; “Consumer” means a natural person using the Service for purposes outside their trade, business, or profession; and “Business User” means any other user.
By creating an account, purchasing a plan, or otherwise using the Service you agree to these Terms and to the Privacy Policy, which is incorporated by reference. If you use the Service on behalf of a company or another person, you confirm that you are authorised to bind them, and “you” refers to them as well. If you do not agree, do not use the Service.
You must be at least 18 years old to use the Service. We do not knowingly allow accounts for minors and will close any account we learn belongs to one.
You sign in with a Google account, and your AiBrush account is tied to that identity. Keep your Google credentials secure and do not share access to your AiBrush account. Everything done through your account, including the use of Credits, is treated as done by you, unless it results from a breach of our security. Tell us promptly at support@aibrush.co if you suspect unauthorised use.
One person may hold one account. Creating multiple accounts to obtain a first-month offer more than once, to evade plan limits, or to evade a suspension is a breach of these Terms, and we may merge, suspend, or close such accounts. We may decline to open an account or to provide the Service at our reasonable discretion.
The Service lets you generate and edit media with artificial-intelligence models operated by AiBrush and by third-party providers, organise the results in a library, and, through Ad Studio, plan and produce advertising material. The features, models, limits, and plans available at any time are described in the Service and on the Pricing page.
We continually develop the Service. We may add, change, or remove features, models, and plans, and may offer features on a preview or beta basis that can change or be withdrawn without notice. We aim for high availability but do not guarantee that the Service will be uninterrupted, error-free, or that any particular model or provider will remain available. Planned maintenance may occasionally make the Service unavailable.
Support is provided by email at support@aibrush.co. We respond to every message in the order received, prioritising billing and account-access issues, but we do not commit to a response time.
4.1 Credits. Generations consume Credits. New accounts start with no Credits. Paid plans add a Credit allocation at the start of each billing period. The Credit cost of a generation is shown before you submit it. When a generation is queued, its Credit cost is reserved; it is charged when the generation completes successfully and released back to your balance if it fails or is cancelled.
4.2 Credit rules. Credits have no monetary value, are not currency, cannot be transferred, sold, or redeemed for cash, and may be used only within the Service. Credits do not expire: unused Credits carry over from one billing period to the next, and Credits from a plan or a pack stay in your account after your subscription ends or you cancel. All Credits are forfeited, without compensation, when your account is closed or terminated. We may change the Credit cost of individual models or operations for future generations; the applicable cost is always the one shown in the Service at the time you submit a generation.
4.3 Billing. Paid plans are billed monthly in advance through our payment processor, Stripe. By subscribing you authorise recurring charges to your payment method until you cancel. Prices are in US dollars and include applicable taxes, such as VAT. AiBrush does not receive or store your full payment card details. We will give you at least 30 days’ notice by email before a price increase takes effect on your renewal, and you may cancel before then.
4.4 Cancellation. You may cancel a paid plan at any time from your account settings or by emailing support. Cancellation takes effect at the end of the billing period you have already paid for; the plan remains active until then and is not renewed afterwards. We do not refund any part of a billing period that has already started, except as set out in section 4.5 or required by law.
4.5 Right of withdrawal and refunds. If you are a Consumer in the European Union or European Economic Area, you have a statutory right to withdraw from a purchase within 14 days without giving a reason. Because the Service is a digital service that begins immediately, when you purchase a plan you expressly request that we start providing it at once and acknowledge that you lose the right of withdrawal in respect of that purchase once you use any of its Credits. If you have not used any Credits from a purchase, you may withdraw within 14 days by emailing support@aibrush.co and we will refund the purchase in full. Otherwise, refunds are given only where required by applicable law or, at our discretion, where the Service materially failed to deliver a generation you were charged for.
4.6 Failed payments and chargebacks. If a renewal payment fails, we may retry it, restrict paid features, or move your account to the Free plan until payment succeeds. If you dispute a charge with your bank rather than contacting us, we may suspend your account while the dispute is resolved and may recover any amounts, fees, and Credits associated with a charge that is reversed.
5.1 Ownership. You retain all rights you hold in your Inputs. As between you and AiBrush, you own the Outputs generated for you, and to the extent AiBrush holds any right, title, or interest in Outputs, we assign it to you upon generation. Because Outputs are produced by AI models, they may not be protectable by copyright in every jurisdiction, and similar or identical Outputs may be generated for other users from similar Inputs; we make no promise of uniqueness or of any particular legal protection.
5.2 Licence to AiBrush. You grant AiBrush a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, transmit, adapt (for example by transcoding or resizing), and display your Inputs and Outputs solely as needed to operate, secure, support, and improve the technical delivery of the Service for you, including transmitting them to the AI providers that perform a generation. This licence ends when you delete the content or close your account, except for copies retained in backups or as required by law, as described in the Privacy Policy.
5.3 No training, no showcase without consent. We do not use your Inputs or Outputs to train or fine-tune artificial-intelligence models, and we do not use them in marketing, galleries, or showcases unless you separately and expressly opt in for the specific content.
5.4 Your responsibilities. You are solely responsible for your Inputs and for how you use your Outputs. You represent and warrant that you own or have all rights, licences, and consents needed for your Inputs, including the consent of any real person whose likeness, image, or voice you upload or ask the Service to reproduce, and that your Inputs and your use of Outputs comply with applicable law and these Terms.
5.5 Review before use. Outputs are generated automatically and may be inaccurate, incomplete, offensive, or biased, and may unintentionally resemble existing works or people. You must review Outputs before relying on them, publishing them, or using them in any way that could affect others. Outputs are not professional advice of any kind.
5.6 Synthetic-media disclosure. Where you publish or distribute Outputs that depict real people, places, or events, or that a reasonable person could mistake for authentic recordings, you are responsible for labelling them as artificially generated or manipulated where applicable law, platform rules, or advertising standards require it.
You must not use the Service, or allow others to use it, to create, upload, request, or distribute content that: is illegal in Sweden, the European Union, or the place where you or the intended audience are located; sexualises or exploits minors in any way; depicts a real person in a sexual or intimate context without their explicit consent; impersonates a real person, organisation, or authority in a deceptive way, or presents synthetic media as authentic to mislead; is defamatory, harassing, threatening, or incites violence, hatred, or discrimination against any person or group; is intended to defraud, manipulate elections, or spread disinformation; or infringes anyone’s copyright, trademark, privacy, publicity, or other rights.
You must not: reverse-engineer, scrape, crawl, probe, or overload the Service; bypass or attempt to bypass rate limits, Credit accounting, safety checks, moderation, or access controls; use automated means to access the Service other than through interfaces we provide; introduce malware; resell, sublicense, or share access to the Service or your account without our written agreement; use the Service to build a competing product by systematically extracting Outputs; or use the Service to make decisions with legal or similarly significant effects on people, including in employment, credit, insurance, housing, healthcare, or law enforcement.
The AI providers behind the Service apply their own usage policies, and requests they refuse cannot be fulfilled. We may update this section as the law and the technology evolve.
We use automated safeguards, including a check that blocks face-swap requests involving minors and the content-safety filters of our AI providers, and we may review content that is flagged by those systems or reported to us. We may refuse, remove, or disable access to Inputs or Outputs that we reasonably believe breach these Terms or the law, and we may report unlawful content to the competent authorities.
We may issue a warning, restrict features, suspend, or terminate an account that breaches these Terms, in proportion to the severity and frequency of the breach. Where the law requires, we will tell you the reason and how to contest the decision. You may contest any enforcement action by emailing support@aibrush.co; a person will review it.
The Service, including its software, design, models we operate, documentation, trademarks, and all related intellectual-property rights, belongs to AiBrush or its licensors. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable right to access and use the Service. No other rights are granted.
If you send us feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use them without any obligation to you. AiBrush, AiBrush Studio, and our logos are trademarks of AiBrush AB and may not be used without our written permission.
The Service depends on third parties: Google for sign-in and cloud infrastructure, Stripe for payments, Cloudflare for content delivery and storage, and AI model providers for generation, as described in the Privacy Policy. Their availability and policies affect the Service, and their terms may apply to certain content, for example provider usage policies that govern what may be generated. We are not responsible for third-party websites or services that we link to or that you connect to the Service.
If you believe content in the Service infringes your copyright or other rights, email support@aibrush.co with: your name and contact details; a description and location (URL or account) of the content; a description of the work or right you say is infringed; a statement that you believe in good faith that the use is not authorised; and a statement that the information is accurate and that you are the rights holder or authorised to act for them. We will review complaints promptly, may remove or disable the content, and may notify the user who provided it. We may close the accounts of repeat infringers.
Our Privacy Policy explains what personal data we collect, why, who we share it with, how long we keep it, and the rights you have. It forms part of these Terms. If you upload Inputs that contain other people’s personal data, you are responsible for having a lawful basis to do so.
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that Outputs will be accurate, lawful to use in your context, free of third-party rights, or suitable for any purpose.
Nothing in these Terms limits the statutory rights you have as a Consumer, including rights under the Swedish Consumer Sales Act and the EU rules on digital content and digital services, and nothing in these Terms excludes liability that cannot be excluded by law.
13.1 Consumers. If you are a Consumer, we are liable for damage caused by our breach of these Terms or by our negligence in accordance with applicable law. To the extent permitted by law, we are not liable for loss of profit, loss of business, or indirect losses that we could not reasonably have foreseen when you accepted these Terms, and we are not liable for losses caused by your breach of these Terms or by the content of your Inputs.
13.2 Business Users. If you are a Business User, then to the fullest extent permitted by law: our total aggregate liability to you arising out of or in connection with the Service in any twelve-month period is limited to the amount you paid us for the Service in that period; and we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profit, revenue, data, goodwill, or business, however arising.
13.3 Exceptions. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot be limited or excluded under applicable law.
If you are a Business User, you will defend, indemnify, and hold harmless AiBrush and its officers, employees, and contractors from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your Inputs, your use of Outputs, your breach of these Terms, or your violation of any law or third-party right. We will notify you of any such claim and give you reasonable control of its defence, provided you do not settle a claim in a way that imposes obligations on us without our consent.
These Terms apply from the moment you first use the Service until your account is closed. You may stop using the Service at any time and may ask us to close your account and delete your data by emailing support@aibrush.co from the address linked to your account.
We may suspend or terminate your access, in whole or in part, with immediate effect if you materially breach these Terms, if we are required to do so by law or by a provider, if your account is used in a way that creates risk for the Service or other users, or if you have not paid amounts due. Where reasonable, we will give you notice and an opportunity to remedy the breach first. We may also discontinue the Service or a plan on at least 30 days’ notice, in which case we will refund any prepaid fees for the period after discontinuation.
On termination, your right to use the Service ends, remaining Credits are forfeited, and your data is deleted in accordance with the Privacy Policy. Sections that by their nature should survive termination, including sections 5, 8, 12, 13, 14, 17, and 18, survive.
We may update these Terms to reflect changes in the Service, the law, or our business. For material changes we will give you at least 30 days’ notice by email to the address on your account or by a prominent notice in the Service, and the effective date at the top of this page will be updated. If you do not agree to a change, you may close your account before it takes effect; continuing to use the Service after the effective date means you accept the updated Terms. Changes required by law or that only add functionality may take effect immediately.
These Terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by the laws of Sweden, without regard to its conflict-of-law rules. If you are a Consumer resident in another country, you also benefit from any mandatory consumer-protection rules of that country, and nothing in this section deprives you of them.
If you have a complaint, please contact us first at support@aibrush.co; we will try to resolve it with you directly. Consumers resident in Sweden may refer a dispute to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN, Box 174, 101 23 Stockholm, www.arn.se). Consumers resident in the European Union may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.
Subject to the mandatory rules above, the courts of Sweden have exclusive jurisdiction, with the Stockholm District Court (Stockholms tingsrätt) as the court of first instance. Consumers may bring proceedings in the courts of their country of residence where the law so provides.
These Terms, together with the Privacy Policy and the plan details shown at checkout, are the entire agreement between you and AiBrush regarding the Service and replace any earlier agreements. If any provision is found invalid or unenforceable, the remaining provisions remain in force and the invalid provision is replaced by a valid one that comes closest to its intent. Our failure to enforce a provision is not a waiver of it.
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to an affiliate or to a successor in connection with a merger, acquisition, or sale of assets, and will notify you if we do. Neither party is liable for delay or failure caused by events beyond its reasonable control, except for payment obligations. We may send notices to the email address on your account; you may send notices to support@aibrush.co. You must comply with applicable export-control and sanctions laws and must not use the Service if you are subject to sanctions that prohibit it.
These Terms are written in English. Translations are provided for convenience; if a translation conflicts with the English version, the English version prevails to the extent permitted by law.
